NYPD CAPTAIN FOUND NOT GUILTY ON ALL COUNTS

In May of 2019, Mr. Caliendo was part of the trial team representing a high ranking police captain, indicted for Official Misconduct. He allegedly delayed the breathalyzer test of a fellow detective suspected of DWI. Mr. Caliendo vehemently believed in his client’s innocence from the moment they met. Throughout the trial, the defense systematically dismantled the prosecution’s case, nearly resulting in dismissal even before a verdict. Instead, the judge permitted the parties to make closing arguments, and then she acquitted the defendant of all charges, just moments after the prosecutor finished delivering his summation.

Law enforcement followed the case closely, given the rarity of charging such a high ranking official with a crime. Indeed, he was the first Japanese-American to make the rank of captain in NYPD history. The case received significant media attention:
